Terms of Service
These terms govern your use of Videophile ("the Service"), operated by [LEGAL ENTITY NAME] ("we", "us"), at videophile.app. By creating an account you agree to them. If you do not agree, do not use the Service.
1. What the Service does
Videophile generates short-form video and podcast content using artificial intelligence, and can publish that content to third-party platforms you connect, including YouTube. You direct what is created; we provide the tools that create it.
2. Your account
- You must be at least 18, or the age of majority where you live.
- You are responsible for activity under your account and for keeping your credentials secure.
- One person or organisation per account. You may not share access in order to circumvent plan limits.
3. Content and ownership
Your inputs
You keep all rights in the topics, scripts, prompts and other material you provide. You grant us a limited licence to process that material solely to operate the Service — to generate, render, store and publish content at your direction.
Generated output
You own the video and audio the Service generates for you, to the extent such output is capable of ownership, and may use it commercially.
An important limitation. AI-generated material may not be eligible for copyright protection in some jurisdictions, and similar output may be generated for other users from similar inputs. We cannot and do not warrant that output is unique, or that it does not resemble existing works. If exclusivity matters to your use, take independent advice.
Accuracy
AI systems produce plausible-sounding errors. You are responsible for reviewing content before it is published. The Service provides review and approval steps for this purpose; using automated publishing does not transfer that responsibility to us.
4. Acceptable use
You may not use the Service to create or publish content that:
- infringes anyone's intellectual property, privacy or publicity rights;
- depicts a real, identifiable person saying or doing something they did not, without their consent;
- is unlawful, defamatory, harassing, or promotes violence or hatred;
- sexualises minors, or depicts minors inappropriately in any way;
- constitutes spam, coordinated inauthentic behaviour, or is intended to mislead about who is speaking or what occurred;
- violates the terms of any platform you publish it to.
We may suspend or terminate accounts that breach this section, without refund. We may do so immediately where there is risk of harm or of our platform integrations being restricted.
5. AI disclosure
All content produced by the Service is AI-generated. Where a platform requires such content to be disclosed, the Service applies that disclosure automatically and you may not disable it. Attempting to circumvent it is a breach of these terms.
6. Connected platforms
When you connect a third-party account, you authorise us to act on your behalf within the permissions you grant. You can revoke access at any time in that platform's settings or by disconnecting the account here.
Your use of YouTube through the Service is also subject to the YouTube Terms of Service, and Google's privacy practices are described in the Google Privacy Policy. You are responsible for complying with the rules of every platform you publish to.
7. Plans, credits and payment
- Paid plans are billed in advance on a recurring basis until cancelled.
- Monthly plan credits expire at the end of each billing period and do not roll over. Separately purchased credit packs do not expire while your account is active.
- Credits are consumed when content is successfully generated. Failed generations are not charged; any credits held for them are released automatically.
- Credits have no cash value and cannot be transferred or redeemed for money.
- Payments are processed by Paddle, which acts as merchant of record. Paddle's terms apply to the transaction itself.

8. Service availability and changes
We aim to keep the Service available but do not guarantee uninterrupted operation. The Service depends on third-party AI providers and platform APIs whose availability, pricing, capabilities and policies may change without notice to us. We may modify or discontinue features, and will give reasonable notice of material changes that reduce what a paid plan provides.
9. Your data on termination
If you cancel or we terminate your account, you may download your generated content for 30 days, after which we may delete it. Content already published to your own platforms is unaffected and remains yours. See the Privacy Policy for retention detail.
10. Disclaimers
The Service is provided "as is". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that output will be accurate, original or suitable for your purposes.
11. Limitation of liability
To the fullest extent permitted by law, our total liability arising from or relating to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data, goodwill, or for any suspension, penalty or loss of access imposed on you by a third-party platform.
12. Indemnity
You will indemnify us against claims arising from content you generate or publish using the Service, and from your breach of these terms or of any platform's rules.
13. Changes to these terms
We may update these terms. Material changes will be notified by email or in the Service at least 14 days before taking effect. Continuing to use the Service after that means you accept the change.
14. Governing law
These terms are governed by the laws of [JURISDICTION], and the courts of [CITY, COUNTRY] have exclusive jurisdiction, without regard to conflict-of-laws rules.
